ONLINE COURSES – TERMS & CONDITIONS

These terms and conditions apply to online courses and information provided by Te Ataarangi ki te Kāhui Maunga Charitable Trust.

Services

Te Ataarangi ki Te Kāhui Maunga Charitable Trust provides online Te Reo Māori programmes. The organisation retains the right to modify courses and change details at its discretion. Courses may be canceled with a minimum of thirty days’ notice.

Payment / Registration

Payment for the Online Course must be made either in full within one week of receiving the invoice or through an agreed direct debit plan of four payments over eight weeks before the course begins. You are responsible for ensuring payment. If payment is not received, access to the course will be denied. Access will be reinstated once payment is made.

Courses will be invoiced in New Zealand Dollars (NZD). Accepted payment methods include bank transfer, credit/debit card or direct debit.

 

You agree to provide accurate and complete registration information. By submitting your registration and paying the full fee, you accept these Terms and Conditions.

Cancellations and Refunds

You may cancel your registration up to the start date of the programme and receive a full refund. After the course begins, a 50% refund is available for up to two weeks.

Te Ataarangi ki Te Kāhui Maunga Charitable Trust reserves the right to cancel the Online programme by providing written notice (including by email) at any time before the course starts. In such cases, all fees paid will be refunded.

 

Te Ataarangi ki Te Kāhui Maunga Charitable Trust’s liability for canceling an Online Course is limited to refunding the payment or any other charges paid for the canceled programme. For partial cancellations, refunds will be issued proportionately.

 

Please note that all dates are subject to change. Notice of any changes will be provided, but refunds will not be issued for rescheduled classes.

Copyright

All materials – including but not limited to text, photographs, video, audio, images and any other content – appearing via the Reo Kōrero LMS and/or on the Website are protected by copyrights and/or other proprietary rights belonging to Te Ataarangi ki Te Kāhui Maunga Charitable Trust. You agree to abide by all applicable laws regarding copyrights, trademarks, publicity rights and privacy rights in NZ, Australia, the US, UK and any other jurisdiction from which you are accessing the Website.

You may not copy, reproduce, duplicate, distribute, disseminate, publish, post, display, perform, modify, create derivative works from, upload to, transmit, or in any way exploit any content from the Online Course and/or on the Website.  You may not sell or offer for sale any of the content, or allow third parties to access it, or use such content to construct any kind of database. You may use the content from the Online Course and/or on the Website only for personal, non-commercial use.

You agree to maintain the security of any username and password required for accessing the Online Course. You will notify us promptly if you become aware of any unauthorized use of your username and/or password. Only you may access the course using your login details.

Data Protection

By registering with Te Ataarangi ki Te Kāhui Maunga Charitable Trust and paying the fees, you consent to the collection and use of your personal data in accordance with Te Ataarangi ki Te Kāhui Maunga Charitable Trust’s Privacy Statement.

Technology Requirements

The Online Course is facilitated through an online learning management system. It is your responsibility to ensure that you have the proper hardware and software requirements, along with access to Wi-Fi, to be able to participate in the course. Te Ataarangi ki Te Kāhui Maunga Charitable Trust is not responsible for any errors or failures in relation to your ability to access the Online Course, the Website or any related materials, including where such errors or failures are caused by:

(i)             a loss of connection on the Reo Kōrero LMS or your end;

(ii)            a breakdown or problems with the online software and/or

(iii)          a breakdown or problems with your internet connection, computer or system.

Limitation of liability

Except in cases of intentional misconduct or gross negligence, Te Ataarangi ki Te Kāhui Maunga Charitable Trust accepts no liability for any damages arising from the services under this agreement. This includes, but is not limited to, damages such as data loss, operational failures, lost revenue, or missed profits.”

 

Term

The service is available for the duration of the course, as determined by Te Ataarangi ki Te Kāhui Maunga Charitable Trust.

Law and venue

Any disputes arising from this agreement are governed by New Zealand law and must be resolved in the courts of New Zealand.
